CAFE standards for Hybrids

A hybrid naysayer said that hybrids are not required to comply with CAFE standards. Supposedly this is because the low emission level of the electric-gas combination exempts hybrids from CAFE standards. He said as battery efficiency decreases over time and the car relies more on the gas engine that the emissions will exceed CAFE standards. I think he is a moron. Anyone substantiate or refute this? Sources?
